Under what circumstances will the court grant a divorce?


Answer: Article 32 of China's Marriage Law stipulates:


If any of the following circumstances exist and mediation is ineffective, a divorce should be granted:


(1) Bigamy or cohabitation with another person while having a spouse;
(2) Implementation of domestic violence or abuse, or abandonment of family members;
(3) Having gambling, drug addiction or other bad habits that are incorrigible;
(4) Separation due to emotional discord for two years or more;
(5) Other circumstances that lead to the breakdown of the marital relationship.


In addition to the above five circumstances, if one party is declared missing and the other party files for divorce, the divorce should be granted.
